These terms govern use of Swimio, a personal swim-training log for recording pool sessions, reviewing history, comparing two logged swims, keeping reusable plans, and reading trends. By installing or using Swimio, you agree to this User Agreement. If you do not agree, do not use the app.
01 The service
Swimio lets you keep a local training book: manual sessions, set-by-set work, parked plans, history filters, side-by-side comparison, and statistics. Optional tools include read-only Apple Health import, a short spoken note after a swim, a session photograph, and a kiosk that sells lane marks.
Swimio is provided for personal, non-commercial use on Apple devices you own or control.
02 Eligibility
You must be at least 18 years old, or the age of majority where you live if that age is higher, to use Swimio and to make in-app purchases. Swimio is not directed at children under 13.
03 License
We grant you a limited, non-exclusive, non-transferable, revocable license to use Swimio for personal training records. You may not copy, modify, distribute, reverse engineer, rent, or sublicense the app except where the law forbids that restriction.
04 Your training book
You are responsible for the sessions, plans, notes, and photographs you store. Keep the device under your control. Swimio does not provide a cloud account that can restore a deleted book from our servers, because this version does not keep your book on a Swimio server.
Imported Health workouts remain Apple Health records. Removing a copy from Swimio does not delete the Health workout.
05 Health, microphone, and photographs
Apple Health access is optional and read-only. You may refuse it and still log swims by hand.
The microphone is used only when you choose to record a spoken note. Photographs are attached only when you pick an image through the system picker. Swimio does not claim a right to your entire photo library.
06 Lane marks and in-app purchases
Lane marks are a consumable balance on the device. Compare spends marks. The first three parked plans are free; each extra parked plan spends marks. Packs in the kiosk add marks after Apple completes the purchase.
Prices shown in the kiosk are the fares Swimio lists for those packs. Payment is processed by Apple. Refunds, billing questions, and family-sharing rules follow Apple’s terms and the App Store. Unused marks are not a cash balance and are not transferable off the device.
If a purchase is interrupted, Swimio attempts to seat a finished pour when Apple later delivers the transaction. You should not assume a pack is on the book until the kiosk confirms it.
07 Not medical or coaching advice
Swimio is a log, not a medical device, and not a substitute for a coach, physician, or lifeguard. Distances, pace, and charts are only as accurate as the values you enter or the workouts Apple Health provides. Do not rely on Swimio for injury diagnosis, training prescription, or safety in the water.
08 Acceptable use
You agree to use Swimio lawfully. You must not interfere with StoreKit, HealthKit, or Keychain, attempt to falsify purchases, or use the app in a way that harms other people or the service.
09 Availability
Features may change, pause, or end when the operating system, Health access, StoreKit, or the app itself changes. Swimio may be unavailable during maintenance, device errors, or circumstances outside reasonable control.
10 Disclaimer
Swimio is provided “as is.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and uninterrupted or error-free operation. We do not warrant that imported Health workouts, spoken notes, photographs, or mark balances will survive device failure, OS migration, or uninstall.
11 Limitation of liability
To the fullest extent permitted by law, Swimio and its operator are not liable for lost training records, lost marks, lost photographs, lost audio, missed workouts, or indirect, incidental, or consequential damages arising from use of the app. Some places do not allow certain limits; in those places, liability is limited to the maximum the law allows.
12 Termination
You may stop using Swimio by deleting your records and uninstalling the app. We may restrict use if you breach this agreement, abuse purchases, or create a security risk. Provisions that should survive — including intellectual property, disclaimers, and limitation of liability — remain in effect.
13 Changes
We may revise this User Agreement. The effective date will change. Continued use after a revision takes effect is acceptance where the law treats it that way.
